GENERAL CONDITIONS OF ELECTRONIC CONTRACTING AND USE OF THE CENTERS FOR ART, CULTURE, AND TOURISM

GENERAL TERMS AND CONDITIONS OF ELECTRONIC CONTRACTING

These General Terms and Conditions of Use and Electronic Contracting of EPEL-CACT (hereinafter referred to as the “General Terms and Conditions”) govern access to and the contracting of products and services by the User through the website www.cactlanzarote.com (hereinafter referred to as the “WEBSITE”).

The use of the public WEBSITE, whether for consultation, booking, or contracting goods or services, or the private WEBSITE through a username and password as a collaborator, confers the status of a WEBSITE user (hereinafter referred to as the “USER”).

Online purchases made through this website are governed by the provisions of Royal Legislative Decree 1/2007 of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws; Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce; and other applicable regulations, as well as these General Terms and Conditions. Unless otherwise stated, the USER may complete the purchase process in the same language in which these General Terms and Conditions are written.

Identification of the Parties

On the one hand, the Local Public Business Entity Centros de Arte, Cultura y Turismo del Cabildo de Lanzarote (hereinafter EPEL-CACT), with Tax ID: Q-3500356-E and registered office at Ctra de San Bartolomé, nº 71, 35500 Arrecife de Lanzarote, Las Palmas. On the other hand, the USER, who declares to be of legal age (over 18 years old) and to have the necessary legal capacity to purchase the services offered through the WEBSITE and to use it in accordance with the General Terms and Conditions outlined below, which they expressly declare to understand and accept.

GENERAL INFORMATION

In compliance with the information obligation established in Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the following details are provided:

EPEL-CACT operates the WEBSITE and the Centros de Arte, Cultura y Turismo de Lanzarote. Hereinafter referred to as “EPEL-CACT,” it offers and manages the contents, products, and services for the USER of the WEBSITE.

The owner of the WEBSITE reserves the right to make any modifications or updates to its contents and services, as well as to these General Terms and Conditions, at any time and without prior notice.

USER

Access to and/or use of the public WEBSITE, whether for consultation, booking, or purchasing goods or services, or the private WEBSITE through a username and password as a collaborator, grants you the status of a user of the WEBSITE (hereinafter, “USER”), who accepts these General Terms and Conditions from the moment of access and/or use. These General Terms and Conditions shall apply directly upon accessing the WEBSITE content.

Access to the WEBSITE is completely free and does not require prior subscription or registration. The USER agrees to access the WEBSITE in accordance with the principles of good faith and these General Terms and Conditions of Use, with access and use being carried out under their sole responsibility.

The USER also agrees to use the content and services offered through the WEBSITE in a lawful, diligent, and appropriate manner, always complying with current legislation and these General Terms and Conditions.

It is the USER’s responsibility to carefully read these General Terms and Conditions each time they access the WEBSITE, as they may be modified. Updates to the General Terms and Conditions will be published on the WEBSITE and will be deemed accepted by the USER by continuing to use the WEBSITE after the publication of such modifications.

SERVICE DESCRIPTION

EPEL-CACT manages the WEBSITE and the Centres for Art, Culture, and Tourism of Lanzarote, hereinafter referred to as “EPEL-CACT,” offering and administering content, products, and services to the USER of the WEBSITE.

Prices

The ticket sales and reservation portal will provide clear and accurate information about the prices of products or services, specifying, where applicable, any potential additional charges and service conditions. The prices published on the WEBSITE and in the ticket sales and reservation portal include the applicable taxes in each case.

CACT Lanzarote is committed to updating the prices and content on the WEBSITE with the utmost diligence to ensure they are always accurate and up to date. However, in the event of a typographical error, CACT Lanzarote will correct such errors as soon as possible. Furthermore, if any price contains a mistake that unintentionally affects a USER who could not reasonably identify the error, CACT Lanzarote will honour the initially offered price for that USER.

USER OBLIGATIONS

The PRODUCTS AND SERVICES made available to the USER on the WEBSITE are offered on the condition that the USER accepts, without modification, all the terms and conditions detailed in these General Conditions. By accessing or using the WEBSITE in any way, the USER agrees to be bound by these General Conditions and confirms that they have read and understood their content.

Please read the General Conditions carefully, as they include information concerning your legal rights and any limitations thereof, as well as a section regarding the applicable legislation and jurisdiction in case of disputes. If the USER does not accept all the General Conditions, they must refrain from using the WEBSITE or purchasing any PRODUCTS or SERVICES. For all purchases and/or reservations of PRODUCTS or SERVICES, it will be assumed that the USER has consented to accept these General Conditions on behalf of all individuals included in the purchase or reservation and has provided them with the information contained in the Personal Data Processing Policy available on this WEBSITE.

Future changes or modifications to the General Conditions may occur under the terms outlined herein. The USER understands and agrees that continued access to or use of the WEBSITE after such changes signifies acceptance of the updated or modified General Conditions. The date of the latest modifications to the General Conditions will be indicated at the top of this page. All modifications will take effect immediately upon publication. The USER is encouraged to periodically review this page to access the most current version of the General Conditions.

The USER is responsible for providing accurate information during the purchase and/or reservation processes established on the WEBSITE. The fields for purchases and/or reservations allow free data entry, meaning the WEBSITE cannot identify or correct errors in the submitted information. The USER must exercise the utmost care in completing these fields. A USER purchasing a product or service at a reduced rate must present documentation to verify eligibility at the ticket desk upon entry to the venue.

The USER will, in all cases, be responsible for the accuracy of the data provided and must inform CACT Lanzarote of any changes to this information. CACT Lanzarote reserves the right to exclude any USER who has provided false information from the registered services, without prejudice to any other actions permitted by law.

The USER is prohibited from using the WEBSITE to engage in illegal activities or actions contrary to good faith, customs, morals, or public order.

The USER is prohibited from using the WEBSITE to carry out activities that infringe upon intellectual or industrial property regulations or any other applicable legal standards.

CACT Lanzarote reserves the right to deny or withdraw access to the Portal and/or Services at any time and without prior notice to any USER who violates these General Conditions.

Ticket Resale

The resale of tickets for the Centres of Art, Culture, and Tourism of Lanzarote (EPEL-CACT) is strictly prohibited. Tickets are personal and non-transferable and may only be used by the original purchaser. If resale or any unauthorised commercialisation of tickets is detected, the tickets may be cancelled without prior notice and without any refund, and access will be denied to anyone attempting to use a ticket purchased through unofficial channels.

The only authorised points of sale are the official CACT Lanzarote website and the ticket desks at the Centres of Art, Culture, and Tourism of Lanzarote (EPEL-CACT), except for the Cueva de los Verdes, which does not have a ticket desk.

EXEMPTIONS AND LIMITATIONS OF THE CONTRACT

We suggest that you carefully read this section as it limits CACT Lanzarote’s liability to you for any inconveniences that may arise in relation to your use of the WEBSITE and any purchases and/or reservations made through the ticket sales and reservation portal. If you do not understand the terms of this section or any other part of the General Conditions, please consult a lawyer to clarify any doubts before accessing and using the WEBSITE or making a purchase and/or reservation on the ticket sales and reservation portal.

The information, content, software, products, and services published on the WEBSITE may contain inaccuracies or errors, including errors regarding availability and pricing. CACT Lanzarote does not guarantee the accuracy of the information and descriptions of the products and services displayed on the WEBSITE (which includes, but is not limited to, availability, photographs, features, inclusions and exclusions, general product and service descriptions, reviews, ratings, etc.). CACT Lanzarote also assumes no responsibility for errors and inaccuracies in such information and descriptions of products and services. Furthermore, CACT Lanzarote explicitly reserves the right to correct any availability and pricing errors on the WEBSITE and/or in pending bookings made with incorrect pricing.

In the event of the following: business interruptions of any kind (including, but not limited to, the loss of data and/or information and the costs of acquiring replacement goods or services); the USER’s access, viewing, or use of this WEBSITE; delays or inability to access, view, or use this WEBSITE; the comments and opinions displayed on this WEBSITE, the above will apply to any losses, damages, or harm regardless of the cause, even if CACT Lanzarote has been notified of the possibility of such occurrences.

This limitation and exemption of liability does not affect any mandatory legal rights that cannot be excluded under applicable legislation.

Exemptions of Liability in the Case of Events or Services Organised by Third Parties

Third-party providers organising events (hereinafter referred to as “event” or “service”) that are advertised and marketed on this WEBSITE are independent contractors and not agents or employees of CACT Lanzarote. Therefore, CACT Lanzarote will not be responsible for the acts, errors, omissions, statements, warranties, breaches, negligence, or misconduct of any such providers, nor for any personal injuries, death, property damage, or other damages or expenses arising from them, or from any other way related to the purchase, reservation, or use by the USER of a product or service offered by these third parties through this WEBSITE. It is also expressly stated that in the case of events organised by third parties, CACT Lanzarote’s refund policy and right of withdrawal do not apply, as they only apply to CACT Lanzarote’s own products and services. In such cases, the USER will be subject to the general conditions of the direct organiser of these events.

CACT Lanzarote will not be responsible nor offer refunds in the event of any delays, cancellations, overbooking, strike, force majeure, or other causes beyond their direct control, and will not be responsible for any additional costs, omissions, delays, changes in itineraries, or actions of any scheduled event beyond their direct control.

PROCEDURE FOR ELECTRONIC PURCHASE

The USER will select the product or service of interest on the WEBSITE (whether from CACT Lanzarote or third parties), including individual entry tickets for CACT Lanzarote, vouchers, event tickets, table reservations, and/or any other products or services listed on the WEBSITE. They will review the descriptions, features, conditions, and final prices indicated in the product details. After verifying availability, the USER will fill in the required information, such as the event date and/or the number of requested tickets. The USER must carefully check the accuracy of the data entered and ensure no typing errors have occurred. Once the service is selected, the USER must enter the required details in the mandatory fields of the form and begin the electronic purchase and/or reservation process.

Before confirming the purchase, the USER must explicitly read and accept these General Conditions, which include the terms for refunds or returns, and confirm that they have read and accepted the Privacy Policy and the Legal Notice by ticking the corresponding boxes provided for this purpose.

Privacy Policy and Personal Data Protection

CACT Lanzarote is committed to protecting the privacy of users’ personal data. All information collected is used in accordance with our Privacy Policy, which can be consulted at the following link: Privacy Policy. This policy details how we collect, use, store, and protect users’ personal data. All this information is an integral part of these General Conditions.

Once the mandatory data is completed and after clicking on the “Pay,” “Reserve,” or similar button, the USER will be redirected to a secure payment gateway where payment can be made via credit card (Redsys), PayPal, or another system enabled for this purpose.

– After completing the payment, the USER will receive a confirmation email within 24 hours, with the purchase and/or reservation ticket(s) sent to the address provided during the purchase and/or reservation process. This communication will describe the purchase made, as well as its details. If the USER does not receive the email, they should check their “junk” or “spam” folder, and if it is not found there, they should notify CACT Lanzarote as soon as possible to resolve the issue.

The tickets can be stored via reservation storage apps on electronic devices and/or printed. The access staff at CACT Lanzarote will scan the QR code to verify its validity and grant access to the premises or the product and/or service. It is the USER’s responsibility to display their ticket either printed or on a mobile device with a readable QR code.

Payments and Billing

The payment for services contracted through the WEBSITE must be made in advance, unless explicitly stated otherwise.

The purchase of any product and/or service will only be effective when CACT Lanzarote successfully processes the payment, either by charging a credit/debit card or through PayPal. Until that moment, the transaction may be cancelled by CACT Lanzarote.

To proceed with the payment, the User must follow all instructions provided at the time of purchase, supplying the following information: cardholder name, card type, card number, security code, expiration date, or any other required details during the purchase process. The USER agrees not to provide false data, including names, addresses, and/or payment details, and not to engage in any illegal activity related to the purchase or allow anyone else to do so.

Payment confidentiality is ensured through a secure payment module called Payment Gateway (Secure payment system “Verified by VISA”): payment is made through an independent website. When the payment is processed via the gateway, the USER connects directly to the bank’s website, with no involvement from CACT Lanzarote. CACT Lanzarote does not, under any circumstances, record, store, or have access to the full credit card details of the USER.

PURCHASES CANCELLATIONS

Cancellation of Individual Entrance Tickets to the CACT

The USER does not have the right of withdrawal for the purchase of tickets to the EPEL-CACT for free visits, due to an exception in Article 103, section L) of Royal Legislative Decree 1/2007, of 16 November, which states: “The right of withdrawal shall not apply to contracts related to: the provision of accommodation services for purposes other than serving as housing, transportation of goods, vehicle rentals, food, or services related to leisure activities, if the contracts specify a specific date or period of execution.” Consequently, CACT Lanzarote does not accept changes or refunds once the payment for the tickets for visiting the CACT Centres has been made.

Event Cancellation

If the customer cancels the purchase of an Event, a cancellation fee of 100% of the ticket price will apply.

Cancellation of Services or Events by CACT Lanzarote

CACT Lanzarote reserves the right to cancel services or events. In such cases, the USER may choose one of the following options, subject to the feasibility and approval of EPEL-CACT according to the circumstances:

  • Reschedule the service or event for an alternative date.
  • Opt for an alternative service with a similar value to the contracted activity.
  • Request a 100% refund of the purchase amount, which will be processed via bank transfer to an account number provided by the customer.

Similarly, EPEL-CACT commits to publishing any changes to an event or show on the WEBSITE as soon as it becomes aware of such changes, to ensure USERS are properly informed.

COMPLAINTS AND CLAIMS REGARDING SERVICES PROVIDED BY CACT LANZAROTE

The USER may contact us via email at info@centrosturisticos.com for any questions or queries regarding the operation of our services.

Intellectual Property of the Website

The entire WEBSITE, including text, images, video, sounds, trademarks, graphics, logos, buttons, software files, color combinations, as well as the structure, selection, organization, and presentation of its content, is the property of CACT Lanzarote. Reproduction, distribution, public communication, transformation, retransmission, copying, assignment, or broadcasting of the information contained on these pages, in whole or in part, is prohibited for any purpose and through any means.

The USER agrees to use the services and content on the WEBSITE in accordance with the law and the general and specific terms and conditions of the services offered by CACT Lanzarote. The USER must refrain from using these services to introduce data programs into the network that could damage the computer systems of CACT Lanzarote, its suppliers, or third-party users of the internal network or the WEBSITE.

The USER is not permitted to create links to pages on the WEBSITE without written consent from CACT Lanzarote.

Reproduction, transformation, or distribution of the aforementioned contents is expressly prohibited, as well as any act of decompilation or reverse engineering, except for accessing, viewing, or reproducing them through CACT Lanzarote. Unauthorized or improper use of the information on this website will lead to legal actions and liabilities.

Disseminating content of a racist, xenophobic, pornographic nature, or promoting terrorism and/or violating human rights is expressly prohibited.

CACT Lanzarote shall not be responsible, directly or indirectly, for:

  • The information entered by USERS, collaborators, or third parties.
  • The USER’s infringement of intellectual and industrial property rights, honor rights, personal and family privacy, image rights (photos, videos), property rights, and any other rights belonging to third parties resulting from the transmission, dissemination, storage, availability, reception, acquisition, or access to content.
  • The links and hypertext that allow the USER to access services and content offered by third parties via the WEBSITE, which are not owned or controlled by CACT Lanzarote. CACT Lanzarote is not responsible for the information contained in them, nor for any consequences resulting from such information. CACT Lanzarote does not endorse or guarantee any third-party websites included for the convenience of the USER.

TERMS OF USE OF THE CENTERS OF ART, CULTURE, AND TOURISM

Admission Conditions

To access any of the EPEL-CACT Centers, a valid ticket is required. Tickets are valid for the date and/or period indicated at the corresponding center, in accordance with the specific conditions of each one. Children under 14 years old must be accompanied at all times by an adult responsible for them. It is recommended to purchase tickets in advance and consult the booking and cancellation policies, as they may vary depending on the season or availability.

Ticket duplication or forgery: By purchasing a ticket, the user assumes full responsibility if the ticket is duplicated or forged. In the event that a duplicated or forged ticket is presented, the user will automatically lose their rights to access the venue or event, with no right to claim or receive any compensation.

First valid ticket: Only the first ticket presented for scanning will be considered valid. Any attempt to access with the same ticket afterwards will be denied, with no possibility of a refund or access.

Lost items

The CACT are not responsible for the loss or damage of personal belongings during the visit. If you lose an item, you can report it to the center staff, who will log it according to internal procedures. Recovered items will be kept for a limited period, after which they will be donated or discarded if unclaimed.

Use of cameras and recording devices

Visitors are authorized to take photographs and record videos for personal use using cameras, mobile phones, or other recording devices. However, use for professional or commercial purposes requires prior written permission. Any photographic or videographic material captured within the centers may be used by EPEL-CACT for promotional purposes, and by entering, visitors agree to this condition with no right to any compensation.

Intellectual property of the CACT

All content, designs, and works of art present in any of the Art, Culture, and Tourism Centers of Lanzarote are protected by copyright and other intellectual property laws. Reproduction, distribution, or unauthorized use of any displayed material or content within the CACT, including photographs and videos taken during the visit, for commercial or public distribution purposes is prohibited without prior written consent from the CACT. By entering the facilities, visitors acknowledge and agree to respect these intellectual property rights.

Safety and well-being

For safety reasons, all visitors are subject to inspections and checks at the entrance. It is recommended to familiarize yourself with the emergency exits and evacuation procedures, and to report any incident or suspicious behavior to the center staff immediately.

Right of admission

The Centers of Art, Culture, and Tourism (EPEL-CACT) reserve the right of admission and permanence in their facilities and at the events or activities they organize. This right may be exercised in the following cases:

  • Consumption of Substances: Entry or permanence in the EPEL-CACT venues or spaces will not be allowed for individuals under the influence of alcoholic beverages, narcotics, psychotropic substances, stimulants, or similar substances, or for those carrying such substances.
  • Inappropriate Behavior: Access will be denied or individuals will be expelled for displaying inappropriate behavior, including disrespect towards the organization’s staff or other users.
  • Negative Impact on the Environment: Entry or permanence will be prevented for those whose behavior may negatively affect the space, the experience of other visitors, or the proper functioning of the facilities.
  • Failure to Follow Instructions: CACT Lanzarote may deny access or expel any person who does not comply with the instructions of the organization’s staff or behaves in a manner that disrupts order and security.

EPEL-CACT reserves the right to take any necessary measures to ensure the safety, public order, and proper enjoyment of the facilities and activities by all users.

Responsibility for Damages

Visitors are responsible for any damage caused to the facilities or property of the EPEL-CACT and must compensate EPEL-CACT for any damages incurred.

Economic Sanctions

Failure to comply with the rules set by the EPEL-CACT may result in economic sanctions. These sanctions will be determined based on the severity of the violation.

Dispute Resolution Methods

VISITOR SAFETY AND WELL-BEING RULES FOR MANDATORY COMPLIANCE

Acceptance of Risks

The Centers of Art, Culture, and Tourism of Lanzarote (CACT) are spaces that, due to their natural or historical nature, involve certain inherent risks that visitors voluntarily accept when accessing them. These risks include, among others, falls, bumps, personal injuries, or other damages arising from uneven surfaces and pavements, stairs and narrow spaces, low-height areas, which may be particularly risky for tall individuals, as well as areas that, by their nature, may be wet. People with reduced mobility or any other physical limitations should assess the suitability of the visit, considering the specific characteristics of this environment.

Safety

Visitor safety is a priority at the CACT. Therefore, all visitors are required to follow the instructions of the staff, respect the signs and notices placed on the premises, and stay within the designated routes.

It is recommended to wear non-slip, comfortable, flat, and closed shoes suitable for walking through our spaces, along with comfortable clothing. Additionally, pets are not allowed, except for assistance dogs. Visitors are responsible for their personal safety as well as the safeguarding of their belongings.

Environmental Protection

The CACT are protected spaces that require special conservation. Therefore, it is strictly prohibited to touch or alter plants, sculptures, and natural formations. Smoking is only permitted in designated areas. Furthermore, to preserve the environment and respect the experience of other visitors, flash photography is not allowed, except in areas where it is specifically authorized.

Specific Rules for Each Center

Jameos del Agua

  • In this space, there is a risk of “high tide,” meaning the water may cover the path in some areas and wet the feet of visitors. In such cases, it will be necessary to remove your shoes to cross.
  • Throwing coins or objects into the lake water is prohibited due to the presence of protected species, such as the blind crab.
  • Swimming is not allowed in the lake or the pool, nor is it permitted to dip hands or feet into either place.

Montañas del Fuego (Timanfaya)

  • The geothermal heat characteristic of this environment poses an additional risk. Visitors are urged to exercise extra caution and avoid leaving the designated areas.
  • During the vehicle tour, it is prohibited to exit the vehicle, except in designated areas, such as the Islote de Hilario.
  • Geothermal demonstrations require due attention to avoid accidents.

Castillo de San José – MIAC

  • Due to the historic design of this castle, visitors should be aware that stairs and uneven surfaces may present additional risks.
  • It is important to maintain a safe distance from works of art and refrain from using flash photography in the exhibitions to protect the displayed pieces.

Cueva de los Verdes

  • As an enclosed underground volcanic space, this center may not be suitable for people with claustrophobia, reduced mobility, or other physical limitations. It is recommended that each visitor carefully assess their condition before deciding if the visit is advisable.
  • There are specific restrictions regarding areas where photography is allowed. Please follow the instructions of our staff.

Jardín de Cactus

  • Special attention is required for children, particularly near the pond and large cactus plants, which may present a danger.

Mirador del Río

  • Due to its elevated location, Mirador del Río poses risks associated with height and the possibility of strong winds in certain areas.
  • It is essential to respect the safety barriers to avoid falls, especially in the observation areas or balconies, and keep children supervised at all times.

LEGISLATION

These General Terms and Conditions are governed by Spanish law. The courts of Arrecife in Lanzarote will have jurisdiction over any dispute arising from these General Terms and Conditions, except for any exceptions established by law.

If any clause included in these General Terms and Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, with the rest of the General Terms and Conditions remaining in full effect. The provision, or part thereof, that is affected will be considered as not included.
