GENERAL CONDITIONS OF ELECTRONIC CONTRACTING AND USE OF THE CENTERS FOR ART, CULTURE, AND TOURISM

GENERAL CONDITIONS OF ELECTRONIC CONTRACTING
These General Conditions of Use and Electronic Contracting of EPEL CACT, hereinafter referred to as the “General Conditions,” govern the access and contracting of products and services by the User through the website www.cactlanzarote.com (hereinafter, the “WEBSITE”).
The use of the public WEBSITE for consulting, booking, or contracting goods or services, or the private WEBSITE through a user and password as a collaborator, grants the user status of the WEBSITE (hereinafter, the “USER”).
Online purchases made through this website are governed by the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws, by Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, and other applicable regulations, as well as these General Conditions. Unless otherwise indicated, the USER may make the purchase transaction in the same language in which these General Conditions are written.
Identification of the Parties
On one hand, the Local Public Business Entity Centers for Art, Culture, and Tourism of the Lanzarote Island Council (hereinafter EPEL CACT), with CIF Q-3500356-E, and registered address at Ctra. de San Bartolomé, nº 71, 35500 Arrecife de Lanzarote, Las Palmas. On the other hand, the USER, who declares they are of legal age (over 18 years) and possess the necessary legal capacity to acquire the services offered through the WEBSITE and use it according to the General Conditions detailed below, which they expressly declare to understand and accept.
GENERAL INFORMATION
In compliance with the information obligation stated in article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the following data is provided:

EPEL CACT operates the WEBSITE and the Centers for Art, Culture, and Tourism of Lanzarote (hereinafter, “EPEL CACT”) and offers and manages the content, products, and services to the USER of the WEBSITE.
The owner of the WEBSITE reserves the right to make, at any time and without prior notice, any changes or updates to its contents and services, to these General Conditions, and, in general, to any elements that are part of the design and configuration of the WEBSITE.
USER
The access and/or use of the public WEBSITE for consulting, booking, or contracting goods or services, or the private WEBSITE through a user and password as a collaborator, grants the user status of the WEBSITE (hereinafter, “USER”), which they accept from the moment of access and/or use of the WEBSITE. These General Conditions will apply immediately upon access to the content of the WEBSITE.
Access to the WEBSITE is entirely free and does not require prior subscription or registration. The USER agrees to access the WEBSITE according to principles of good faith and these General Conditions of Use, with access and use made at their sole responsibility.
Furthermore, the USER agrees to use the content and services offered through the WEBSITE in a lawful, diligent, and appropriate manner, always respecting current legality and these General Conditions.
It is the USER’s responsibility to carefully read these General Conditions each time they access the WEBSITE, as they may be modified. Updates to the General Conditions will be published on the WEBSITE and will be deemed accepted by the USER by continuing to use the WEBSITE after such modifications are published.
SERVICE DESCRIPTION
EPEL CACT operates the WEBSITE and the Centers for Art, Culture, and Tourism of Lanzarote (hereinafter “EPEL CACT”) and offers and manages the content, products, and services to the USER of the WEBSITE.
Prices
The sales and booking portal will provide clear and accurate information on the price of products or services, indicating, where applicable, any additional charges and service conditions. The prices published on the WEBSITE and on the sales and booking portal indicate the applicable taxes in each case.
CACT Lanzarote undertakes to update the prices and content on the WEBSITE with the utmost diligence to ensure that they are accurate and up-to-date at all times. However, in the event of any typographical error, CACT Lanzarote will correct such errors as quickly as possible. Likewise, if any price contains an error and a USER has been unintentionally affected and could not reasonably have detected the error, CACT Lanzarote will honor the originally offered price for that USER.
USER Obligations
The PRODUCTS AND SERVICES available to the USER on the WEBSITE are offered on the condition that the USER accepts without modification all the terms and conditions detailed in these General Conditions. By accessing and/or using the WEBSITE in any way, the USER agrees to be bound by these General Conditions and declares that they have read and understood their content.
Please read the General Conditions carefully, as they contain information regarding your legal rights and the limitations of those rights, as well as a section on applicable law and jurisdiction for disputes. If the USER does not accept all the General Conditions, they should not use the WEBSITE or purchase any PRODUCTS or SERVICES. For all purchases and/or bookings of PRODUCTS or SERVICES, it will be considered that the USER performing the action has the consent to accept these General Conditions on behalf of the people included in the purchase or booking of PRODUCTS or SERVICES and declares that they have provided them with the information included in the Data Processing Policy available on this WEBSITE.
Changes or modifications to the General Conditions may be made in the future in accordance with the terms and conditions specified here; in that case, the USER understands and agrees that accessing and using the WEBSITE after such changes means accepting the new updated or modified General Conditions. The date of the last modifications will be indicated at the top of this page. All modifications will take effect immediately after being published. The USER should check this page periodically to review the most current version of the General Conditions.
The USER is responsible for providing their information correctly in the purchase and/or booking processes established on the WEBSITE. The fields for making the purchase and/or booking are freely entered, and therefore the WEBSITE has no means to identify and correct errors in the entered data. The USER must exercise the utmost care in completing them. The USER purchasing a product or service at a reduced rate must present documentation accrediting it at the ticket office when accessing the premises.
The USER is responsible for the accuracy of the data provided and must inform CACT Lanzarote of any modifications. CACT Lanzarote reserves the right to exclude from registered services any USER who has provided false information, without prejudice to any other actions that may be applicable by law.
The USER is prohibited from using the WEBSITE for illicit activities, contrary to good faith, morals, customs, or public order.
The USER is prohibited from using the WEBSITE to engage in activities that violate intellectual property regulations or any other applicable legal norms.
CACT Lanzarote reserves the right to deny or withdraw access to the Portal and/or Services at any time and without prior notice to any USER who violates these General Conditions.
Ticket Resale
The resale of tickets for the Centers of Art, Culture, and Tourism of Lanzarote (EPEL-CACT) is prohibited. Tickets are personal and non-transferable, and can only be used by the original purchaser. If resale or any attempt to commercially exploit the tickets is detected, the tickets may be canceled without prior notice and without any right to a refund. Access will be denied to anyone attempting to use a ticket purchased through unauthorized channels.
The only authorized points of sale are the official website of CACT Lanzarote and the ticket offices available at the Centers for Art, Culture, and Tourism of Lanzarote (EPEL-CACT), except for Cueva de los Verdes, which does not have a ticket office.
Exemptions and Contract Limitations
We suggest you read this section carefully as it limits CACT Lanzarote’s liability to you for any inconveniences arising from your use of the WEBSITE and the purchases and/or bookings made on the sales and booking portal. If you do not understand the conditions of this section or any other part of the General Conditions, consult a lawyer before accessing and using the WEBSITE or making a purchase and/or booking on the sales and booking portal.
The information, content, software, products, and services published on the WEBSITE may contain inaccuracies or errors, including errors regarding seat availability and pricing. CACT Lanzarote does not guarantee the accuracy of the information and descriptions of products and services displayed on the WEBSITE (including, but not limited to, seat availability, photographs, characteristics, inclusions and exclusions, general descriptions of products and services, opinions, ratings, etc.). Nor does it assume any responsibility for errors or inaccuracies in the information and descriptions of such products and services. Furthermore, CACT Lanzarote expressly reserves the right to correct any availability and price errors on the WEBSITE and/or pending bookings made at an incorrect price.
Under no circumstances will CACT Lanzarote be responsible for: business interruptions of any kind (including, without limitation, loss of data and/or information and the cost of obtaining substitute goods or services); access, display, or use of this WEBSITE by the USER; delays or inability to access, display, or use this WEBSITE, comments, and opinions appearing on this WEBSITE. The above applies to losses, damages, or injuries regardless of their basis, even if CACT Lanzarote has been notified of their possibility.
This limitation and exemption of liability do not affect the mandatory legal rights that cannot be excluded under applicable law.
Exemptions of liability in case of Events or Services organized by third parties
Third-party providers that organize events (hereinafter referred to as “event” or “service”) that are advertised and marketed on this WEBSITE are independent contractors and not agents or employees of CACT Lanzarote. Therefore, CACT Lanzarote will not be responsible for the acts, errors, omissions, statements, guarantees, breaches, negligence, or misconduct of any such providers, nor for any personal injury, death, property damage, or other damages or expenses arising from or in connection with the purchase, booking, or use by the USER of a product or service offered by such third parties through this WEBSITE. It is expressly stated that in the case of events organized by third parties, CACT Lanzarote’s refund and withdrawal policies do not apply, as they only apply to their own products and services. In such cases, the USER will be subject to the general conditions of the direct organizer of such events.
CACT Lanzarote will not be responsible or provide refunds in the event of delays, cancellations, overbooking, strikes, force majeure, or other causes beyond their direct control, nor will they be responsible for any additional expenses, omissions, delays, changes in itinerary, or actions related to any scheduled event beyond their direct control.
Electronic Purchase Procedures
The USER will select the product or service they are interested in on the WEBSITE (of CACT Lanzarote or third parties), individual visit tickets to CACT Lanzarote, vouchers, event tickets, table reservations, and/or any other product or service included on the WEBSITE. The USER will review their descriptions, characteristics, conditions, and final prices indicated in the descriptive file. After verifying seat availability, the USER will fill in the required information fields such as the event date and/or the number of seats requested. The USER must carefully review the accuracy of the entered data to ensure there are no errors. Once the service is selected, the USER must input the required data into the mandatory fields of the form and initiate the electronic purchase and/or booking process.
Before confirming the purchase, the USER must read and expressly accept these General Conditions, which include refund or reimbursement conditions, as well as confirm that they have read and accepted the Privacy Policy and Legal Notice, by checking the appropriate boxes provided for that purpose.
Privacy Policy and Personal Data Protection
CACT Lanzarote is committed to protecting the privacy of users’ personal data. All information collected is used in accordance with our Privacy Policy, which can be viewed at the following link: Privacy Policy. This policy details how we collect, use, store, and protect users’ personal data. All this information forms an integral part of these General Conditions.

Once the required data is completed and after clicking on the “Pay,” “Book,” or similar expression button, the USER will be redirected to a secure payment gateway where they can pay by credit card (Redsys), PayPal, or another system enabled for this purpose.
– Once the payment is completed, the USER will receive an email confirmation within 24 hours, with the purchase and/or booking tickets sent to the address provided during the purchase and/or booking process. This email will describe the purchase made, as well as its characteristics. If the USER does not receive this email, they should check their “junk mail” or “spam” folder, and if it is not found, they should contact CACT Lanzarote as soon as possible to resolve the issue.
Tickets can be saved using reservation storage apps on electronic devices and/or printed out. CACT Lanzarote staff will scan the QR code to check its validity and grant access to the facilities or product and/or service. It is the USER’s responsibility to present the ticket either printed or on a mobile device with a QR code that is legible.
Payments and Invoicing
Payment for services contracted through the WEBSITE will be made in ADVANCE, unless expressly indicated otherwise.
The purchase of any product and/or service will only be effective once CACT Lanzarote has successfully charged the amount, either by credit/debit card or PayPal. Until such payment is made, CACT Lanzarote reserves the right to cancel the transaction.
To proceed with the payment, the USER must follow all the instructions indicated at the time of purchase, providing the following information: Cardholder’s name, card type, card number, security code, card expiration date, or any other information required during the purchase process. The USER agrees not to provide false information, including names, addresses, or contact or payment details, and not to engage in any illegal activity in connection with the purchase or allow others to do so.
Confidentiality in the payment process is guaranteed through a secure payment module called Payment Gateway (Secure Payment System “Verified by VISA”): payment is made through an independent website. Since the payment is processed through the gateway, the USER is directly connected to the bank’s website without any intervention from CACT Lanzarote. Under no circumstances does CACT Lanzarote store or have access to the full credit card details of the USER.
CANCELLATION OF PURCHASES
Cancellation of individual entry tickets for CACT visits
The USER has no right to withdraw from the purchase of tickets for EPEL CACT for free visits due to an exception in Article 103, section L) of Royal Legislative Decree 1/2007, of November 16, which states: “The right of withdrawal will not apply to contracts that refer to: The supply of accommodation services for purposes other than housing, transportation of goods, vehicle rentals, meals, or services related to leisure activities, if the contracts provide for a specific date or period of execution.” Therefore, CACT Lanzarote does not accept changes or refunds once the payment for the tickets has been made for visits to EPEL CACT Centers.
Cancellation of events
Canceling an event ticket purchase by the client will result in cancellation charges of 100% of the ticket price.
Cancellation of services or events by CACT Lanzarote
CACT Lanzarote reserves the right to cancel services or events. In such cases, the USER may choose from the following options, subject to feasibility and approval by EPEL CACT based on the circumstances:
- Reschedule the service or event to an alternative date.
- Opt for an alternative service for an amount similar to the contracted activity.
- Request a 100% refund of the purchase amount, which will be processed, when possible, through a bank transfer to a bank account provided by the client.
Similarly, EPEL CACT, in the event of any changes to an event or show, undertakes to publish the changes on the WEBSITE as soon as it becomes aware of them to keep USERS informed.nt or show, commits to publishing it on the WEBSITE as soon as it becomes aware of the changes to keep USERS duly informed.
Complaints and claims for services provided by CACT Lanzarote
We provide the email address info@centrosturisticos.com for the USER to address any questions or inquiries about the functioning of our services.
Intellectual Property of the Website
The entirety of this WEBSITE—text, images, video, sounds, trademarks, graphics, logos, buttons, software files, color combinations, as well as the structure, selection, arrangement, and presentation of its contents—is owned by CACT Lanzarote. Its reproduction, distribution, public communication, transformation, retransmission, copying, assignment, or broadcasting, whether in whole or in part, of the information contained in these pages, for any purpose and by any means, is prohibited.
The USER agrees to use the services and content on the WEBSITE in accordance with the law and the general and specific terms and conditions of the services offered by CACT Lanzarote at all times, refraining from using them to introduce programs or data into the network that may cause damage to CACT Lanzarote’s computer systems, its suppliers, or third-party users of the internal network or the WEBSITE.
The USER may not establish links to web pages of the WEBSITE without the written consent of CACT Lanzarote.
All reproduction, transformation, or distribution of such content, as well as any act of decompilation or reverse engineering, is expressly prohibited, except for access, viewing, or reproduction through CACT Lanzarote. In no case will any extraction, reuse, or exploitation of the content be permitted that involves acts contrary to these conditions or that harm the rights or interests of the service provider, CACT Lanzarote, or third parties. Such exploitation acts may only be carried out with the express authorization of CACT Lanzarote and, in any case, must make explicit reference to the ownership of the aforementioned intellectual property rights. The unauthorized or improper use of the information contained on this website will result in the legally corresponding actions being taken and, where applicable, the liabilities that arise from such actions.
It is expressly prohibited to disseminate content that is racist, xenophobic, pornographic, that promotes terrorism, and/or that violates human rights.
CACT Lanzarote will not be held responsible, either directly or indirectly, for:
- The information entered by USERS, collaborators, and third parties.
- The USER’s violation of intellectual and industrial property rights, rights to honor, personal and family privacy, and image rights of individuals (photographs, videos), property rights, and any other rights of third parties resulting from the transmission, dissemination, storage, provision, reception, or access to the content.
- The links and hypertext that allow the USER to access third-party services and products through the WEBSITE. CACT Lanzarote is not responsible for the information contained on such websites or for any consequences arising from that information. CACT Lanzarote does not sponsor or guarantee any of these third-party websites, which are included for the convenience of the USER.
CONDITIONS OF USE OF THE CENTERS FOR ART, CULTURE, AND TOURISM
Admission Conditions
To access any of the EPEL CACT Centers, a valid ticket is required. Tickets are valid for the date and/or period indicated at the corresponding center, according to the specific conditions of each. Children under the age of 14 must be accompanied by a responsible adult at all times. It is recommended to purchase tickets in advance and consult the reservation and cancellation policies, as they may vary depending on the season or availability.
Ticket Duplication or Forgery: By acquiring a ticket, the user assumes all responsibility in case the ticket is duplicated or forged. In case of presenting a duplicated or forged ticket, the user will automatically lose access rights to the venue or event without any claim or compensation.
First Valid Ticket: Only the first ticket presented for scanning will be considered valid. Any subsequent attempt to access with the same ticket will be denied, without the possibility of refund or access.
Lost Objects
CACT is not responsible for the loss or damage of personal belongings during the visit. If you lose an item, you can report it to the center staff, who will record it according to the internal procedure. Recovered items will be stored for a limited period, after which they will be donated or discarded if not claimed.
Use of Cameras and Recording Devices
Visitors are authorized to take photographs and record videos for personal use using cameras, drones, mobile phones, or other recording devices. However, the use of such devices for professional or commercial purposes requires prior written permission. Any photographic or video material captured within the centers may be used by EPEL-CACT for promotional purposes, and by entering, visitors accept this condition without any right to compensation.
Intellectual Property of the CACT
All content, design, and artworks present in any of the Centers for Art, Culture, and Tourism of Lanzarote are protected by copyright and other intellectual property laws. The reproduction, distribution, or unauthorized use of any material exhibited or contained within the CACT, including photographs and videos taken during the visit, for commercial or public distribution purposes, is prohibited without prior written consent from CACT. By entering the premises, visitors acknowledge and accept to respect these intellectual property rights.
Safety and Well-being
For security reasons, all visitors are subject to inspections and checks upon entry. It is recommended to familiarize yourself with the emergency exits and evacuation procedures and to report any incidents or suspicious behavior to the center staff immediately.
Right of Admission
The Centers for Art, Culture, and Tourism (EPEL CACT) reserve the right of admission and permanence within their facilities and at events or activities they organize. This right may be exercised in the following cases:
- Substance Use: Entry or stay in the EPEL CACT premises or spaces will not be allowed for persons under the influence of alcohol, drugs, psychotropic substances, stimulants, or similar substances, or those carrying such substances.
- Inappropriate Behavior: Access will be denied, or individuals will be expelled if they exhibit inappropriate behavior, including disrespectful attitudes toward organization staff or other users.
- Negative Impact on the Environment: Entry or stay will be denied to those whose behavior may negatively affect the space, the experience of other visitors, or the proper functioning of the facilities.
- Failure to Follow Instructions: CACT Lanzarote may deny access or expel individuals from the premises if they fail to follow the instructions of the organization’s staff or behave in a way that disrupts order and safety.
EPEL CACT reserves the right to take necessary measures to ensure the safety, public order, and appropriate enjoyment of the facilities and activities by all users.
Liability for Damages
Visitors are responsible for any damage caused to the facilities or property of the EPEL CACT Centers and must compensate EPEL CACT for the damages and losses caused.
Financial Penalties
Failure to comply with the rules established by EPEL CACT may result in financial penalties. These penalties will be determined based on the severity of the infraction.
Dispute Resolution Methods

Legislation
These General Conditions are governed by Spanish law. The courts of Arrecife in Lanzarote will have jurisdiction to resolve any disputes arising from these General Conditions, except for any legal exceptions.
If any clause included in these General Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, with the rest of the General Conditions remaining in force, and such provision, or the affected part of it, will be deemed as not having been included.
